NHRLA Legislative Update: February 2024

House Bill 1033 – Advertising of Nominal Dimensions of Lumber 

This bill, which pertains to the labeling and advertising of lumber dimensions, underwent a public hearing in the House Commerce Committee. Our analysis indicates a lack of support for the bill within the committee, and it is evident that the members recognize its lack of merit. During the hearing, concerns were raised about the practicality of constant lumber measurement due to shrinkage and water content changes. Notably, a drafting error placing the bill under insurance statutes instead of consumer protection was identified, further underscoring the lack of careful consideration by the sponsor. 

The New Hampshire Timberland Owners Association, represented by Jasen Stock, and the NH Retail Association, on behalf of Home Depot and Lowes, expressed opposition. However, the committee has not pursued further action on this bill, and discussions with committee members suggest minimal support. 

Senate Bill 438 – Use of Lumber Harvested in the United States for State Building Projects 

This legislation, requested by the New Hampshire Retail Lumber Association (NHRLA), focused on lumber grading. Following a meeting with the Structural Engineers of NH, a subset of the Engineers Association, it was revealed that the bill language was not as originally submitted. However, productive discussions led to satisfactory commitments from the Structural Engineers of NH, prompting NHRLA to request the bill’s placement in “Interim Study.” The committee has endorsed this move, indicating future consideration for similar legislation. 

The introduction of this legislation successfully brought the engineers to the table, aligning with our strategic objectives. 

House Bill 1628 – Regulatory Authority for Apples, Coal Grading, Potatoes, Cider, Milk, and Lumber 

This bill, currently unscheduled for a public hearing, proposes repealing RSA 434:59 concerning the grading and certification of native lumber. The bill addresses wood processed in New Hampshire and outlines certification requirements for mills. As of now, no substantial developments have occurred, but we are monitoring the situation closely.

Senate Bill 462 – Removing the Cap on Damages for Wrongful Death Loss of Consortium Claims 

Recently brought to our attention, this bill aims to eliminate the cap on damages for wrongful death and loss of consortium claims. Notably, the opposition is coalescing among hospitals, the medical society, The Associated General Contractors, Business & Industry Association, and local chambers of commerce. The bill remains in committee, and we have attached testimony from the hearing for your reference. The bill language is available here
